Leaving a lease early without it following you

Florida leases often contain an early termination option the tenant accepted separately. Whether yours does changes the whole calculation.

A tenant who needs to leave before the lease ends has more options than walking away, and walking away is the one with the longest tail. The first question is what the lease says. Florida permits a liquidated damages or early termination provision, accepted separately by the tenant, capped at a defined number of months' rent. Where that exists, the exit is priced: give the notice specified, pay the stated amount, and the obligation ends. Where it does not, the tenant remains liable under the general rule and the landlord's duty to mitigate shapes what is actually owed. The second option is assignment or sublet, which almost always requires the landlord's written consent and, in a condominium, the association's approval too. A replacement tenant the landlord approves is frequently the cleanest outcome for both sides. The third is negotiation. A landlord facing a month of vacancy in a strong rental season may prefer a tenant who leaves cleanly, gives long notice and helps show the unit. What does follow a tenant is the unpaid balance: a judgment, collections and a mark on the rental history that the next landlord's screening will surface. Military members have separate statutory protections for orders-based moves, and those are worth knowing about specifically. Whatever route is taken, do it in writing and get the release in writing. A verbal "don't worry about it" from a landlord is not a release, and the person who said it may not be the person holding the lease a year later.
