Managing property for someone else in Florida requires a licence

Renting, leasing or collecting rent on another owner's property for compensation is licensed activity. The exemptions are narrower than people assume.

Florida regulates real estate activity performed for another person for compensation, and that includes renting and leasing. Someone who advertises units, shows them, negotiates leases or collects rent on an owner's behalf, for a fee, is generally doing licensed work. There are exemptions, and they are specific rather than general. An owner dealing with their own property is not acting for another. Salaried on-site employees of an apartment complex have a carve-out for leasing units in that complex. An officer of the entity that owns the property stands in a different position than a third-party contractor. Community association management is its own separate licence with its own requirements. What tends to catch people is the informal arrangement: a handyman who starts collecting rent, a friend who manages two units for a share, an out-of-state owner's local contact who signs leases. Compensation plus acting for another owner is the test, and neither the size of the fee nor the number of doors changes it. The consequences are not only regulatory. An unlicensed manager may be unable to enforce a claim for their own compensation, and the owner who hired them inherits the problem. For anyone building a management business, the clean path is straightforward: the licence, a written management agreement that sets out the scope, a proper trust account for funds that belong to owners and tenants, and insurance that matches the work.
